Federal High Court Admits N1 Billion Damages Judgment Against Nigerian Government in Nnamdi Kanu Case

Key Evidence Accepted in Ongoing Trial

The Federal High Court in Abuja has formally accepted three significant judgments as evidence, including the landmark N1 billion damages award against the Nigerian government by Justice Benson Anya of the Abia State High Court.

Background of the Case

This substantial award stems from the controversial 2017 military invasion of the residence of Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB). Justice Anya’s judgment, delivered in a fundamental rights suit filed by Kanu, had previously declared the September 2017 military operation as illegal, unlawful, and unconstitutional.

Court’s Ruling on Human Rights Violations

The court ruled that the military action violated Kanu’s fundamental rights to life, dignity of person, liberty, and fair hearing, as guaranteed by both the 1999 Nigerian Constitution and the African Charter on Human and People’s Rights.

Additional Evidence Admitted

The court also admitted certified true copies of judgments in two other related cases:

  • Suit FHC/UM/CS/30/2022 (Nnamdi Kanu vs FRN) delivered on October 26, 2022
  • Suit E/20/2023 (Kanu vs FRN) delivered on an unspecified date

Legal Proceedings

Justice James Omotosho formally admitted the three judgments during Wednesday’s proceedings, marking them as exhibits PWL, PWM, and PWN. The evidence was presented by the defense team during cross-examination of prosecution witness Mr. BBB, conducted by senior advocate Mr. Paul Erokoro (SAN).

Current Status of Nnamdi Kanu

Kanu has remained in DSS detention in Abuja since his controversial extraordinary rendition from Kenya on June 27, 2021. The IPOB leader was arrested by Kenyan security operatives working in collaboration with Nigerian authorities.
